01Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and ArchiTECH MSP ("ArchiTECH," "we," "us," or "our"), headquartered at 127 W. Rodney French Blvd., New Bedford, MA 02744. By accessing or using our website at architechmsp.com or any of its features — including the cybersecurity self-assessment, contact forms, and newsletter — you agree to be bound by these Terms. If you do not agree, do not use the site.
These Terms govern your use of the website and the free tools offered through it. They do not govern paid managed services, which are covered by a separate Master Services Agreement, Statement of Work, and, where applicable, a Business Associate Agreement or Data Processing Addendum.
02Who May Use the Site
You must be at least 18 years old and legally able to enter into binding contracts to use this website. By using it, you represent that you meet these requirements and that any information you provide about yourself or your organization is accurate.
03The Cybersecurity Self-Assessment — Important Disclaimer
Our free cybersecurity self-assessment is an educational tool designed to give you a general sense of your organization's security posture across common categories. It is not:
- A comprehensive security audit or penetration test.
- A formal risk assessment meeting HIPAA, PCI DSS, CMMC, SOC 2, or any other regulatory or contractual standard.
- Legal, compliance, or professional advice.
- A substitute for a thorough, engagement-based review performed by ArchiTECH or another qualified provider.
The score, recommendations, and report produced by the assessment are based solely on your self-reported answers. Acting on them — or failing to act on them — is your decision and responsibility. Real-world security outcomes depend on the accuracy of your answers, the implementation of controls, and many factors outside the scope of this tool.
04Acceptable Use
You agree not to:
- Use the site for any unlawful purpose, or in violation of any applicable federal, state, or international law.
- Attempt to probe, scan, or test the vulnerability of the site or circumvent any security measures (beyond good-faith disclosures sent in writing to us).
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Submit content that is fraudulent, harmful, defamatory, obscene, infringing, or otherwise objectionable.
- Harvest, scrape, or collect any information from the site using automated means without prior written consent.
- Use the site to transmit malware, phishing content, spam, or any other unwanted communications.
- Attempt to gain unauthorized access to any portion of the site, our systems, or the data of other users.
We reserve the right to investigate and cooperate with law enforcement regarding any suspected violation of these Terms.
05Intellectual Property
The website, including all text, graphics, logos, icons, images, audio, video, software, methodology descriptions, and the overall look and feel, is the property of ArchiTECH MSP or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the site for your personal or internal business evaluation purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or otherwise exploit any part of the site without our prior written consent, except that you may print or save individual pages for your own non-commercial reference.
"ArchiTECH," "ArchiTECH MSP," and our logos are trademarks of ArchiTECH MSP. All other trademarks referenced are the property of their respective owners.
06Your Submissions
When you submit information through contact forms, the self-assessment, or the newsletter, you represent that: (a) the information is accurate; (b) you have the right to submit it; and (c) submitting it will not violate any third-party rights or any law. We handle the information you submit in accordance with our Privacy Policy.
You grant ArchiTECH a non-exclusive, royalty-free, worldwide license to use any non-personal feedback you voluntarily provide (for example, suggestions about our tools or content) to improve our services, without obligation to you.
07Third-Party Links & Services
Our website may link to, or integrate with, third-party sites and services (including LinkedIn, Google Maps, calendar booking, and email providers). We do not control those services and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.
08Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT AND TOOLS — INCLUDING THE CYBERSECURITY SELF-ASSESSMENT — ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHITECH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the site or its server are free of viruses or other harmful components. You assume full responsibility for any decisions you make based on content or tools available on the site.
09Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARCHITECH MSP OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR RELIANCE ON ANY CONTENT OR TOOLS PROVIDED THROUGH IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; to the extent such limits are unenforceable, our liability will be limited to the fullest extent permitted by law.
10Indemnification
You agree to indemnify, defend, and hold harmless ArchiTECH MSP and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the website; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) content you submit through the site.
11Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. The exclusive venue for any action arising out of or relating to these Terms or your use of the site will be the state or federal courts located in Bristol County, Massachusetts, and you consent to the personal jurisdiction of those courts.
12Dispute Resolution
Before filing any formal claim, you agree to first contact us at info@architechmsp.com and attempt in good faith to resolve the dispute informally for a period of at least 30 days. Most disputes can be resolved without litigation.
13Termination
We may suspend or terminate your access to the website at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will survive.
14Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date at the top of this page and, where appropriate, providing additional notice. Your continued use of the site after an update constitutes acceptance of the revised Terms.
15Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ArchiTECH MSP concerning your use of the website. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
